The hits just keep on coming for Fox Prop. Why won't it settle?? Curious. A large cache of new documents was released Tuesday as part of the $1.6 billion defamation lawsuit filed against Fox News by Dominion Voting System. The material includes a large selection of exhibits mentioned in past legal motions that have generated headlines and controversy for the network. Among the documents released Tuesday was an email from Fox Corp. chairman Rupert Murdoch to Fox News CEO Suzanne Scott that the organization was “Still getting mud thrown at us! … Maybe Sean and Laura went too far. Certain political leaders inspire grudging respect or even fear from their opponents, but let’s face it: House Speaker Kevin McCarthy (R-Calif.) is not among them. His latest political gambit, a ham-handed attempt to rewrite the history of the Capitol insurrection in collaboration with Fox News host Tucker Carlson, was not just a spectacular faceplant. It turned out to be a service to all of us. The episode has also further discredited Fox News as it reels from extraordinary revelations showing network executives and personalities privately acknowledging in emails and texts that claims of a stolen election were preposterous even as they amplified those claims on the air. It’s long been argued that Fox News is in no real sense a news organization but is instead a propaganda machine that advances the interests of the Republican Party. Gee, this sounds familiar. Where have I read about such witness "preparation" before?? Hmmm. Oh, that's right, Cassidy Hutchinson. The GOP cult and Fox Propaganda have much in common in terms of their witness "preparation." Grossberg was subpoenaed by Dominion last year to discuss her work on televised segments in which Bartiromo discussed far-fetched and unproven claims of election fraud. But in her deposition prep sessions, the producer claims, Fox lawyers “were displeased with her being too candid” and took extra time “to make sure she got her story straight and in line with [Fox’s] position.” She said she was urged to give generic answers such as “I do not recall” and discouraged from offering explanations of how Bartiromo’s understaffed team was unable to keep up with warnings from Dominion about false statements they had aired. www.washingtonpost.com/media/2023/03/20/fox-news-abby-grossberg-gag-order-dominion/

I did see my old constitutional law professor, Larry Tribe, on MSNBC yesterday, and he said that Dominion's case was the strongest defamation case he had ever seen, that the judge should seriously consider granting Dominion's motion, and that Dominion should not settle. It warmed my heart.

It’s not just Democrats who believe that Fox News hosts and their guests lied repeatedly about Dominion Voting System efforts to “steal” the 2020 election. It’s also the opinion of Superior Court Judge Eric M. Davis. Davis in a ruling on Friday regarding Dominion’s defamation suit against the network held that on 20 occasions, Fox made false accusations that Dominion tampered with voting results. (Disclosure: I’m an MSNBC contributor.) “Through its extensive proof, Dominion has met its burden of showing there is no genuine issue of material fact as to falsity,” the judge wrote. Since Fox never disputed falsity, Davis concluded: “The evidence developed in this civil proceeding demonstrates that is CRYSTAL clear that none of the Statements relating to Dominion about the 2020 election are true.” Fox’s motion for summary judgment was rejected, meaning the suit will go to trial. Fox claimed it is protected by a “neutral report” privilege — that is, it can repeat false statements that are “newsworthy.” New York law does not recognize such a defense, Davis stated. I've been calling it propaganda since December 2021. What took Robinson so long?? “Fox News” is a misnomer. Rupert Murdoch’s cable network isn’t really a news organization. It just plays one on television — and deserves to lose the $1.6 billion Dominion Voting Systems defamation lawsuit that soon will go to trial. I generally root for the defendant in libel and defamation suits. Journalism is a human endeavor, which means that however hard we try to get everything right, sometimes we fail. The Supreme Court has rightly set a high bar for plaintiffs who claim they were wronged by the media, recognizing that the First Amendment’s protection of press freedom must allow for tough reporting, sharp commentary and honest mistakes. This case, for me, is a glaring exception. What Fox did to Dominion was not journalism. It was more like a mugging.
