There are four prongs for a TRO in DC:
(1) that he or she is likely to succeed on the merits of his or her claims;
(2) that he or she is likely to suffer irreparable harm without preliminary relief;
(3) the balance of equities between the parties support an injunction; and
(4) the injunction is in the public interest

In addition to the sworn statement given with the TRO, a criminal complaint was filed with MPD and GUPD.

That, to me, is credible. Not saying it makes them guilty in a court of law, or even public opinion. But it is a credible accusation.

If someone at the university knew the full allegation but chose to only tell Pat something along the lines of “hey Josh broke a rule and you should keep him out one game and cut his minutes in half” without informing him of the other players or what happened then we shouldn’t have a basketball team. If Pat got that bit of info and didn’t insist on getting the full details he shouldn’t be a college coach that is the leader of young men. This was like the Rick Pitino defense. “I had no idea what my coaches were doing.” Well that’s not a good excuse.

To be clear I am not saying Pat is the only person to blame or is even the worst person in this situation. Everyone involved including the players and anyone that knew should pay the price. We can’t pretend we are a holier than thou program that plays by the rules and then pull this. If anything we should be overly cautious when dealing with matters like this. I am a firm believer in innocent until proven guilty but in that case what changed today? If we aren’t going to be a major player again we can at least be proud of the team we root for.

Honestly I think this is a fair reaction. It is just quite possible that he wasn’t getting direct answers. I deal with sensitive issues and am expected to live with half answers. And it is very frustrating. I just suspect that there was a review process that he probably was not involved directly in. I really am not arguing with anyone. All reactions are valid tonight.

The lawyers have to be involved now and should have been for quite a while. The statement we got from the University touts how the school ensures that all student conduct allegations are investigated thoroughly. That pretty strongly implies that those investigations took place here or are ongoing. It would be absolutely crazy to let Alexander and Gardner play now if they have been credibly accused of a significant crime. And I don't know why in hell they would have allowed LeBlanc to play at all if there was credible evidence that he did. Neither Ewing nor any coach would have the power to overrule the school's legal department on something like this. So what either happened or came to light in the last 48 hours that led to the news today?

The school can't go into radio silence on this. And yes, Reed and DeGoia have to be right there to answer questions with Ewing when they do talk. And that ought to be tomorrow.

For the record I am not sure Josh was kicked off the team for this allegation. I think this may have got outed because he and James decided to transfer out of frustration. I think it’s possible Josh was just sick of Pat punishing him for whatever reason and left and James went with him. maybe Pat really is an incompetent basketball coach that was responsible for his 2 best players leaving but isn’t a unethical person. That is bad for Pat as a coach but is much better for the school. I’d rather Pat be a bad coach and a good person than a bad person and a bad coach. Maybe Pat truly was clueless to it all and we are all rooting for a terribly corrupt program. None of those scenarios are great.

I mentioned it to another AD and they said it was more than two in the Big 10.

But, with the Georgetown team there were TROs, but no charges brought. If there were charges brought, there is no chance they should be playing. TROs don't take a lot to get granted, but a real fear or perceived threat. If someone has made a threat and it can be shown or the person claiming seems to be bothered by it, the judge normally will grant it. But, because charges aren't or haven't been brought doesn't mean nothing happened, but we live in the US and our laws protect a person until proven guilty.

I had a teammate of mine in high school that was accused of rape/sexual assault of a female classmate at a party. He was a high major prospect with offers from multiple top programs in the country. The newspapers and local media ran with the story when it broke and dragged his name deep in the mud. After a few months of investigating, it turned out she was lying. She admitted to it because she was embarrassed that people caught her at the party and she was cheating on her boyfriend.

My teammate lost all his high major scholarships and ended up at a D2. What was a top local story on the local news and front page headlines in the local newspapers when the story broke became back page small column paragraph when the charges were dropped.

Now in no way am I saying that these young ladies allegations aren't credible. I don't know if they are or not because we are not privy to all the information but I do know that these young men are innocent until proven guilty and have the right to due process in the event any charges are brought against them.

My teammate did end up transferring back up to an ACC school after a year or two at the D2 school.

Thank you! The complaint made allegations of burglary, sexual harassment/assault. If there was any hard evidence of any of these serious allegations, more would have happened to these young man then having TRO's filed against them. We don't have all the facts and I refuse to condemn these young man or the Coach & the program like some posters on here are breaking there necks trying to do without all the facts...

Anytime you have a client that is involved with a group of individuals that are indicted with criminal activity you try to counsel for as much distance as possible. Whether that be a physical change in behavior, or a physical relocation; the intent of the action is to produce the allusion of disconnect. Hence, Mac trying to seem way less thuggish and covering his tats/ball is life act.

The ironic part is that I think it may actually be better if Josh was punished for something completely unrelated to this allegation. If that is the case then Galen and Myron would keep playing. Guess we find out in a few days.

From reading all the pages, am I correct that a TRO was issued against LaBlanc, Alexander and Gardner, but only LaBlanc has been accused of violating the TRO?
If so, that would explain why Gardner and Alexander have not been dismissed from the team. “Not guilty until proven guilty” was the apparent position of the coaching staff. Therefore LaBlanc was not dismissed immediately. The investigations concerning the two female accusers could take some time, but the accusation that LaBlanc has violated the TRO could have been done in short order. If so and it was determined that he did violate the TRO then he would have violated the law and school rules may have required his dismissal. The accusations against Alexander and Gardner will still go forward and be resolved in court or in some other way depending on the strength of the accusations. I can understand Ewings frustrations given all the freshman orientations league wise and school wise for in coming basketball players. No judgment on the guilt or innocence of LaBlanc to the initial charges but Ewing’s decision to limit Lablanc’s play could just be his frustration of Lablanc allowing himself to be placed in the position of being charged of the first accusation.

I’ve been a die hard Hoya fan for the better part of 39 years and while we’ve had our ups and downs...never have I been ashamed to be a fan of the program ...until now. This is devastating on so many levels...and I honestly am not sure where we go from here. While a fan of Coach Ewing, I just don’t see how he recovers from this. Off court issues aside, in my mind he had two years left to get the Hoyas into the tourney before he faced the hot seat. Now, his time is suddenly up. Whether Coach Ewing could have or should have foreseen the events that have unfolded, its indisputable that it happened under his watch and There is no getting around that.

Regardless of what happens With the players involved...would any of us be surprised if our recent recruits withdrew their commitments? I for one would not and wouldn’t blame them. What a mess!!
