www.wired.com/threatlevel/2009/05/prison-awaiting-hostile-bloggers/Before this ridiculously unconstitutional bill is considered, let alone passes (god forbid), there are a few things I need to get on the record with impunity: Bando, you are a @#$%%$ soulless, heathen pinko! Jack, you like @$@$% awful music, and you should be ashamed! Buffalo, your hometown is a @#@#%$ infested $#!^-hole! As for you, hifi, you $#%$# go to hell! You @#$@#$ go to hell and you #@#$@ die! Whew. If I waited a little longer to say those things, I could wind up in the pokey for a couple of years. ;D -----> ------> ------->

I would say there is no way this passes, but yesterday in the land of the Magna Carta the Home Secretary said an American radio jockey was banned from ever entering the UK because she detested his political views (which have never even been accused of inciting violence.)
Who knew that when Free Speech was finally destroyed it would not be at the hands of Fascists or Communists but rather at the hands of Sensitivity?

Should we all go over to the Syracuse board now and get our punches in before it becomes criminalized?

If this somehow miraculously managed to pass, it would get struck down faster than you can even say "gross violation of the 1st Amendment."

I agree this bill is stupid, but I doubt it's unconstitutional. Statutes prohibiting non-electronic harassment have previously been upheld, and I don't see why electronic speech would be any more/less protected.
My problem is that this is a needless piece of legislation whose purpose is to effectively censor teenagers by bullying them from posting anything remotely controversial on the Internet.
Boz, I notice this Rep. is from Los Angeles, so she probably loves smoking bans, too.

I get what these legislators are trying to do (what happened to Megan Meier was horrible), but this is ridiculous. I'm pretty sure electronic threats are treated the same as written and verbal ones, so I don't see the point of this.

I'm thinking that the Ballroom Dancing thread might be the first thing prosecuted under this law.

Unless I misread the article w/ a quick skim, it seems like it would cover MUCH more than just online harassment...like HoyaFoeva would be in maximum security by now.

I believe the law also states that no rumors may be posted anywhere on the internet without confirmation from guhoyas.com

Eh, I find it's a good policy to never believe Wired's representations of free speech or anti-free-speech legislation. It's the magazine that thinks that if you're not getting bizarre porn in your mailbox daily, you hate the Constitution. However, I'm going to have to give a mea culpa on this one, because the part of the Texas harassment statute addressing online communications was recently found to be unconstitutional, even though other parts of that statute have survived facial challenges in the past. Amazingly, the text of that statute is nearly identical to the text of the bill in question. FYI the case is Karenev v. State, 258 S.W.3d 210. It's on appeal in a higher court at the moment. Not sure what (if anything) is happening in other jurisdictions. FWIW, I'm usually not this pleased when I'm (probably) wrong.
