The NY Attorney General has issued a cease and desist order to Fanduel and DraftKings to stop operating in NY because they involve gambling.

It seems to me a comparable analogy would be horse racing. It takes skill to know the horses and jockeys, to read the tout sheets, and to pick winning horse/jockey combinations. Those that do that best will win more money. In fantasy sports, those who have the skill to pick the best fantasy players generally win. Not sure I see all that much difference. At least, that was my initial reaction. No doubt in my mind that fantasy betting should be regulated.

I agree with your conclusion, but I'm not sure how picking the best players on a single day is a "skill" though. That's such a small sample size, and I think the fact that these really aren't "skill-based" games is one of the biggest reasons they should be classified as betting and regulated.

As a devotee of the Sport of Kings for many decades, I totally agree with hoyainspirit - except that there's no question that betting on horse racing is gambling - it's just statutorily permitted in most states. I don't see Draft Kings et al as so much different.

The main issue comparing horse racing to DFS is that one has a physical location while the other is online. If only certain states allow DFS companies to operate, that is where they will be.
