Any conflicts could have been avoided by scheduling the game on another date or at another time.

It happens a lot. Example: Direct TV has a deal with Major League Baseball to show games from local cable stations. But Fox has a deal with Major League Baseball to show a "Game of the Week" at 1PM on Saturdays. Because MLB wants to promote this game of the week, the deal they signed with DirectTV does not allow DirectTV to show any games on the Extra Innings Package on Saturdays before 5PM. That all makes perfect sense to me. The way you stated it above, "ESPN has a no-compete with CBS," is what confused me. I thought you were saying there was a contract between the two stations, which didn't make sense to me.
