For what it's worth, ND lost to Tulsa today 28-27, on a FG with 3 minutes to go, at home. After that performance, they can now fire Kelly for pure incompetence and don't even have to bring the kid's death into play.

Russky, it's funny you should mention that. When I first heard about this story and then saw that Notre Dame was playing the golden Hurricanes this past weekend, I saw some irony there, and even wondered if they might cancel/reschedule the game to show some sort of reverence or the sort towards the family. I'm sure nothing big will come out of playing the game, but you still have to kind of think twice about it, don't you?

That's what I don't understand. Why does a big-time school like ND (and T Boon University for that matter) not have permanent structures for video taping? You know these schools all have fancy indoor practice facilities. In other words, if you can build this: www.und.com/facilities/nd-loftuscenter.htmlyou can build a few towers.

If I am ND's insurance carrier and lawyers, based upon the admissions against interest made by Father Jenkins, ND settles prior to a lawsuit even being filed. The settlement will be confidential, but for the announcement of the establishment of a scholarship in Sullivan's name and the donation of seed money for said scholarship.
I can't believe he would have issued that statement without having run it by ND's lawyers and disscussed the ramifications of such a statement.

I agree that is highly likely, but no where in the statement does it suggest they didn't talk to the lawyers first. Still, for the Prez to take responsibility like that?? Doesn't happen in this country very often anymore.

Actually, I am speculating that he did speak with the insurance carrier/lawyers first, that's why he'd issue such a statement essentially conceding liability. ND has already decided to compromise this claim prior to the filing of a wrongful death action by the Sullivans.

This case never sees the inside of a courtroom. Absent some statutory cap on damages under Indiana law, the family gives a number and ND pays. Maybe a little less gold in the helmet paint for awhile.

ND should get a lot of props for just doing the right thing, accepting responsibility and trying to express its sympathy to the family. As a trial lawyer, I agree with Elvado. This statement will have no effect on any law suit. It's nice to see a Catholic institution honor its commitment to ethics.

What I was saying is that ND has already decided to compromise the claim, a good decision -- there will be no lawsuit. Also sounds like the University would be putting up any settlement funds, because any applicable insurance carrier would have the call on paying out insurance proceeds, and they're not going to do that at this point.

Not a good year for Kelly or Notre Dame football, regardless of what the win-loss record is. It really makes you doubt the accuracy of the oft-made claim that Notre Dame can't compete as a top-flight football team anymore because of the high standards to which they hold their athletes.
