A fair amount of the questioning today focused on this issue.
I think she is going to lose some votes for this, but she'll still be confirmed.
Interesting that erstwhile Republican, current Democrat and soon to be ex-Senator Arlen Specter has indicated a strong possibility of voting no.

When it comes up for appointment, I will oppose the Supreme Court confirmation of the potentially dishonest American College of Obstetricians and Gynecologists.
Imagine that Organization A is planning to release some kind of document, and Person B—a GW alum—says to Organization A, "I would love it if you would include 'GW has the best basketball team in the history of college basketball' in your document." If Organization A prints "GW has the best basketball team in the history of college basketball," I would personally blame Organization A for the falsity of the document that it released. Person B's statement may be (and in this hypothetical, is) inaccurate or dishonest. But Organization A is responsible for the content of its own reports.
That's my take, at least.
I would also like to see some info on this allegation from someone a bit less biased than "Shannen W. Coffin, an attorney in Washington, D.C., [who] was the deputy assistant attorney general in charge of the defense of the federal Partial-Birth Abortion Ban Act during the Bush administration."

It's a fair point strummer, but it doesn't excuse what she did.

Mr. Obama is the President. It is within his purview to select a nominee for the Supreme Court. I may not agree with his selection or approve of Ms. Kagan's resume/experience/world view, but I fail to see anything in her past that disqualifies her from service. Last I checked, there were no specific qualifications required by the Consitution save citizenship (not sure on age). Barring some heinous fact in her past she should be confirmed. Of course, so should Robert Bork have been.

And while it may be a bit late for Robert Bork, I think that Obama should, as a showing of good faith and bipartisanship, appoint Miguel Estrada to a federal bench. It won't happen, but it should.
