We can only hope that CA Bar is successful and that similar disbarment proceedings are carried out in NY and DC for Rudy Giuliani and Jeffrey Bossert Clark. All corrupt and unethical MAGA shysters. The State Bar of California intends to seek the disbarment of former president Donald Trump’s election attorney John Eastman for his role in trying to overturn the results of the 2020 election. In a statement, the office of California Bar’s Chief Trial Counsel George Cardona said Eastman faces 11 disciplinary charges, all arising from allegations that he was behind Trump’s plan to obstruct the count of electoral votes. www.washingtonpost.com/politics/2023/01/26/eastman-trump-disbar-california/

Fake news, right GOP cultists? I wonder if George Santos/Anthony Devolder/Kitara Ravache is paying attention?? A GOP political operative was sentenced to 18 months in prison on Friday for his involvement in transferring illegal campaign contributions from a Russian national to former President Trump’s 2016 presidential campaign. Benton presented himself as the contributor, according to the department, which it said caused Trump campaign entities to state in their reports to the Federal Election Commission (FEC) that Benton was the source of the contribution instead of the Russian individual. thehill.com/regulation/court-battles/3864434-gop-political-operative-sentenced-to-18-months-over-illegal-russian-contributions-to-trump-campaign/

Mango ordered to testify again. Ha ha ha. A federal judge on Thursday ordered that former president Donald Trump and FBI Director Christopher A. Wray can be questioned under oath by attorneys for two former senior FBI employees who allege in separate lawsuits that they were illegally targeted for retribution after the FBI investigated Russia’s interference in the 2016 presidential election. The decision by U.S. District Judge Amy Berman Jackson of Washington came in consolidated lawsuits against the FBI and Justice Department by former senior FBI agent Peter Strzok and former FBI lawyer Lisa Page. www.washingtonpost.com/dc-md-va/2023/02/23/trump-deposed-fbi-lawsuit/

That's because now it's the other guy's fault, even though that's not the case. But the imbecilic base will be right there with him.

The U.S. Constitution requires presidents to be over 35 years old, a U.S. citizen, a U.S. resident for at least 14 years, and, as decided by the 39th Congress in 1868, not a participant in any rebellion or insurrection against the United States. Section 3 of the 14th Amendment disqualifies any person from holding “any office, civil or military, under the United States, ... who, having previously taken an oath ... as an officer of the United States, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same.” As I have written previously, a historically informed interpretation of those terms leaves little doubt that Trump’s conduct on and immediately before Jan. 6, 2021, may fit the bill, although crucial facts necessary for disqualification are disputed. Likewise, Bruce Ackerman and Gerard Magliocca have argued that Trump can be barred from the presidency if Congress declares that, by encouraging the attack on the Capitol, Trump engaged in “insurrection or rebellion.” The idea of using the 14th Amendment to bar Trump from holding the presidency a second time is gaining traction. Members of Congress are considering legislation that would create the “legal mechanics” to implement the disqualification provision. Meanwhile, a public interest group has promised to file lawsuits pursuing Trump’s disqualification under the 14th Amendment, citing “overwhelming” evidence that he “engaged in insurrection” by inciting the Jan. 6 attack. www.lawfareblog.com/disqualification-office-donald-trump-v-39th-congress

The hits just keep on coming!! I anticipate that the DC Circuit will adopt the DOJ's position. (My first four years at DOJ were in this section now called Constitutional and Specialized Torts). Former president Donald Trump can be held liable in court for the actions of the mob that overtook the U.S. Capitol on Jan. 6, 2021, the Justice Department said Thursday. “Speaking to the public on matters of public concern is a traditional function of the Presidency, and the outer perimeter of the President’s Office includes a vast realm of such speech,” attorneys for the Justice Department’s Civil Division wrote. “But that traditional function is one of public communication. It does not include incitement of imminent private violence.” Two officers with the U.S. Capitol Police, joined by 11 Democratic House members, are seeking to hold Trump liable for physical and psychological injuries they suffered during the riot. Trump has argued he is protected from the lawsuit by the absolute immunity conferred on a president performing his official duties. www.washingtonpost.com/dc-md-va/2023/03/02/trump-jan6-lawsuit-riot/

Another lawyer bites the dust with albeit with a very minor penalty, though. However, what sentient human being would ever retain her for legal services? Yet another figure who promoted Donald Trump’s stolen-election claims has backed down in the face of legal scrutiny. This time it’s the Trump campaign’s then-legal adviser, Jenna Ellis. But even among the succession of walk-backs, this one stands out. That’s because, as part of her censure deal with the Colorado Supreme Court in a disciplinary proceeding, Ellis actually admitted to 10 specific “misrepresentations.” www.washingtonpost.com/politics/2023/03/09/trump-lawyers-remarkable-admission-about-her-stolen-election-claims/
