Civil cases differ from criminal cases in obvious ways: They seek money damages; no one goes to prison; and plaintiffs establish their claims by a preponderance of the evidence, not “guilt beyond a reasonable doubt.” But civil cases differ in another way, too. They have extensive pretrial discovery. Nothing in a criminal case — or impeachment, for that matter — compares to civil discovery, the process of scooping up evidence from depositions of parties and witnesses, requests for documents, and written questions answered under oath. Discovery is more regimented in criminal cases; it primarily involves the prosecution sharing with the defense the evidence it will use at trial, as well as exculpatory evidence. The grifter continues to grift - his suckers continue to fall for it. The district attorney is sifting through millions of pages of his tax records. The state attorney general has subpoenaed his lawyers, his bankers, his chief financial officer — even one of his sons. And that’s just in New York. Former president Donald Trump is also facing criminal investigations in Georgia and the District of Columbia related to his efforts to overturn the 2020 election. Let's see if the DOJ under AG Garland seeks to substitute the United States as defendant under the Westfall Act and defend the sociopath as his speech was part of his official duties and within the scope of his employment. See Carroll v. Trump (on appeal to 2nd Circuit). .
