Wasn't this woman a Federal Prosecutor? Yes she was. An Assistant U.S. Attorney, i.e., line prosecutor in W.D. of Texas, San Antonio. Also currently Flynn's attorney. I'm concerned about her cases. Should I be? She seems absolutely insane.

Yes she was. An Assistant U.S. Attorney, i.e., line prosecutor in W.D. of Texas, San Antonio. Also currently Flynn's attorney. I'm concerned about her cases. Should I be? She seems absolutely insane. The crazier she talks, the less credibility she has. To be sure, other judges (and their law clerks) are aware of lawyer's reputations for honesty and their level of practice. I listened to her entire en banc argument before the DC Circuit in Flynn and she was less than impressive. The DC Circuit relied more upon Jeffrey Wall from the Solicitor General's office at DOJ. He's a Federalist but knows how to present an appellate argument -- and they lost. I don't know of whatever other crazy litigation she may have pending in federal court.

A board may, and indeed must, tabulate the votes submitted by the counties, but “it has no power to go behind the returns and recount the votes.” The state Supreme Court has affirmed this principle even in the face of allegations that the “election law of this State was most grossly violated.” So even if Shinkle’s allegations of massive voter fraud were true—and it’s worth repeating that there is no evidence that that’s the case—it seems unlikely that a court would permit the board to cite this as a basis for certification delay, let alone to investigate the allegations. In addition to defining what role the board should play, the Michigan Supreme Court has also made clear what role a canvassing board may not play, holding many times that canvassing boards may not exercise judicial functions. The facts of Attorney General v. Board of County Canvassers are particularly pertinent. I was mainly talking about from the time when she was a Federal Prosecutor.

I was mainly talking about from the time when she was a Federal Prosecutor. She left DOJ in 1988. Ancient history and likely nothing hinky back then. Her big case was the prosecution of Jimmy Chagra for his assassination of a federal judge in San Antonio. I think the courthouse is named for the judge there. Joe DiGenova and his wife were normal prosecutors. DiGenova was US Atty in DC and I interviewed with his office in 1984. His wife Victoria Toensing was at DOJ, Criminal Division. Both at Giuliani's crazy press conference part of the "elite team" but they have also gone off the rails.
