I do not practice law. I believe this website at Cornell summarizes information on the various views on impeachment noting that the US has a different view of impeachment than that established under English law. www.law.cornell.edu/constitution-conan/article-2/section-4/impeachment. One interesting note is that disqualification from holding office under senate precedent only requires a majority vote. This is different from the 67/100 vote required for removal from office. Hopefully Majority Leader Chuck Schumer recognizes this as there is no way to remove Trump from an office that he no longer holds. I question if he does since it appears a democratic senator has been appointed to preside over the trial. I do not believe the person presiding over the trial is allowed to vote. Biden's agenda could be expedited if the trial calls no witnessed and only requires all the democrats to disqualify Trump from holding future federal office. Hope this helps. As far as I understand, Leahy presiding over the proceedings does not prohibit his voting.

The central question of former President Trump’s second impeachment trial may be very similar to the central question of the first trial. Putting aside the larger discussion about whether a president who is impeached but then leaves office may still be tried in the Senate (questions addressed comprehensively by scholar Keith Wittington here), this trial will depend primarily on examining Trump’s intent. Former President Donald Trump has lost his top impeachment lawyer just days before his trial is to begin, a person familiar with his legal strategy and two attorneys close to the team confirmed on Saturday night. Butch Bowers, a South Carolina lawyer who was reportedly set to play a major role in the Senate’s trial of the former president, is now no longer with the team. Deborah Barbier, another South Carolina lawyer, won’t be either. Anyone signing on to represent Trump is putting the nail in the coffin of their career. No firm will want to be associated with the attorney that chooses to represent this man after what every single one of us knows he's done and attempted to do to our democracy.

CNN reporting all five of the sociopath's lawyers have left. Ha ha ha ha. Paging Lin Wood. Paging Sidney Powell. Ha ha ha ha. Rudy can't be his lawyer because he is a witness. A person familiar with the departures told CNN that Trump wanted the attorneys to argue there was mass election fraud and that the election was stolen from him rather than focus on the legality of convicting a president after he's left office.
