What is it that they don't get, kc? ...Fourth, their clear inability (or disinterest) in understanding Scalia's arguments/questioning in Fisher v. University of Texas. Regarding your fourth point, what is your understanding of Scalia's arguments/questioning in the Fisher v. University of Texas case? For those not familiar, below is the applicable excerpt from the Association's open letter. Many Black students are also “shaken and angry” about comments Justice Scalia stated just months before his untimely death:“There are those who contend that it does not benefit African-Americans to get them into the University of Texas where they do not do well, as opposed to having them go to a less-advanced school, a less — a slower-track school where they do well.”
“They come from lesser schools where they do not feel that they’re being pushed ahead in classes that are too fast for them,” Scalia said. “I’m just not impressed by the fact that the University of Texas may have fewer. Maybe it ought to have fewer. And maybe some — you know, when you take more, the number of blacks, really competent blacks, admitted to lesser schools, turns out to be less.”If the late Justice Antonin Scalia were correct in his assertions, if members of our organization were relegated to a “less-advanced school,” the Black Law Students Association at Georgetown might not even have a vibrant presence on this campus to mourn his passing.What is it in that comment that reflects the Association's inability or disinterest in understanding Scalia's statement?

I'm not quite sure how a justice is supposed to test a party's arguments if he cannot force them to address countervailing arguments/positions. The GULC BLSA appears unable, or uninterested, in advancing anything other than the trite and lazy claim that "Scalia is racist." Perhaps, just perhaps, a justice sitting on the SCOTUS was interesting in having a nuanced, probing back-and-forth with the counsel before the Court. Or maybe he was stating the extreme version of the opposing side to see how counsel countered. In either case, the BLSA could care less.

Instead, it would be pragmatic to conclude that once the political season is under way, action on a Supreme Court nomination must be put off until after the election campaign is over. Isn't that just begging the question? Why should my vote in 2012 not count in 2016? I voted for Obama because of the importance of nominating supreme court justices. Sometimes it's just too easy.

President Obama nominating Marrick Garland to replace Scalia. Of course, of all the people in the country who might be considered, he picks another Harvard Law grad to replace a Harvard Law grad. The other eight justices have law degrees from Harvard or other Ivy League universities. I think it is time for diversity on the Supreme Court, not more Ivy League.
Of course Judge Garland will never be confirmed in this congress.
